Terms and conditions.

Read these terms before creating an account, posting content or donating. Together with the privacy notice, they govern DonoLink. Mandatory law and rights that cannot contractually be limited always continue to apply.
1. Parties and definitions
DonoLink is provided by Tovix, trading as DonoLink, sole proprietorship, Dutch Chamber of Commerce 98227475 and VAT NL005316890B06. In these terms:
- creator: the user who uses a personal page and connected Stripe account to receive voluntary contributions;
- donor: the person who pays a contribution to a creator through a DonoLink page;
- content: profile text, images, media, links, donation name, message and other information provided through DonoLink;
- payment partner: Stripe and any bank, wallet, card network or payment method involved in a payment.
2. Applicability and formation
These terms apply to every visit and use of DonoLink. A creator expressly accepts the version presented during registration; DonoLink records its version, language and acceptance time and sends a durable copy. A donor accepts the version presented at that time before confirming each payment. DonoLink also records the terms version and acceptance time with the payment.
Deviating arrangements apply only when confirmed in writing by DonoLink. An express written arrangement prevails in case of conflict. If a provision is invalid, the remaining provisions remain effective and, where possible, it is interpreted or replaced by a valid provision serving a similar purpose. The user may not transfer the account or this agreement without written permission. DonoLink may transfer the agreement to a legal successor as part of a transfer of the business or service, provided the user's rights are not materially reduced; a consumer retains all mandatory rights.
3. Account, age and verification
A creator must be at least 18, legally competent and authorised to enter this agreement. A minor may use DonoLink only through a parent with parental responsibility or a legal guardian who manages the account in their own name, accepts the terms and remains responsible. A donor must be at least 18. If the donor is under 18, they must have permission from a parent with parental responsibility or a legal guardian for that donation before donating. Where provided by law, such permission may be presumed for a transaction that is customary for someone of that age. The donor may use only a payment method they are authorised to use. DonoLink and Stripe may request evidence of age, identity, residence, business, authority, bank account, source of funds or activities.
You provide complete, accurate and current information; do not use one account for an unauthorised third party; keep login, two-factor, OAuth and OBS details confidential; and immediately report loss, misuse or unauthorised access. Activity through your account is treated as yours unless you substantiate that it was unauthorised despite reasonable security.
Account admission and payment capabilities are not guaranteed. Stripe also determines whether onboarding, payment methods, reserves, refunds, payouts or the connected account remain available. By completing Stripe onboarding, the creator also accepts the applicable Stripe agreement and authorises necessary processing of payments, fees, corrections and payouts.
In addition to emails that belong to your account, such as verification, payments and payouts, DonoLink sends a weekly reminder until you have finished connecting Stripe. You can unsubscribe from that reminder via the link in the email; the other account and payment emails keep coming.
4. Creator obligations
The creator is the donation recipient and is responsible for their page, content, audience and use of received data. The creator:
- truthfully describes who the creator is and the purposes for which voluntary contributions are requested and does not suggest a purchase, right to repayment or guaranteed consideration;
- holds all rights and permissions for profile, alert, audio, video, trade mark and other content;
- complies with law, sanctions, platform rules, Stripe rules and reasonable security instructions;
- treats donors fairly and responds promptly to support, refund, fraud and dispute requests;
- processes donor personal data only lawfully, securely and for a clear purpose and does not publish sensitive or unnecessary data;
- keeps sufficient funds available for refunds, chargebacks, fees and negative balances and cooperates with investigations;
- makes their own correct tax, accounting, registration and reporting filings in the relevant country.
DonoLink does not provide tax, legal or accounting advice and does not guarantee that an activity will be classified as a hobby, gift or business or that a contribution is tax deductible.
5. Donations and payment instruction
A donation is solely a voluntary contribution from the donor to the selected creator, without a purchase or enforceable consideration. No product, access, subscription, assignment, gambling prize, loan, investment, ownership right, repayment promise or guaranteed service may be sold or promised through the donation flow. An alert, name display, message, media request or creator response is not consideration and the creator is not required to display, perform or answer it. Any arrangement a creator nevertheless makes outside that flow does not turn the donation flow into a DonoLink sales service and falls outside DonoLink's authority and responsibility; DonoLink may block such use. DonoLink provides creators only with technical platform functionality and is not a bank, payment institution, escrow service, financial adviser, employer, partner or agent of the creator.
Before confirmation, the donor checks the creator, amount, name, message and payment method, uses only a payment instrument they are authorised to use, and provides no illegal, threatening, discriminatory, privacy-sensitive or infringing content. Because the donor does not purchase a product or service with the contribution, the statutory withdrawal right for an online purchase does not apply to the donation itself. This does not limit mandatory rights, including rights relating to an unauthorised or duplicate payment, technical error, refund or chargeback. Payment is final once authorised by the payment partner, subject to those rights.
Stripe processes new payments as direct charges on the connected creator account and transfers the separate DonoLink fee as an application fee. The creator share is not an internal balance held by DonoLink. Only historical balance from an earlier payment flow may still be handled separately by DonoLink.
6. Rates, fees and payout
These rules describe DonoLink fees. Stripe fees depend on the country, payment method, connected account and current terms; check the actual amount in Stripe after payment:
- DonoLink charges a standard fee of 3.5% per donation, regardless of payment method;
- debit and credit cards may be available when Stripe enables them for the connected account; Apple Pay and Google Pay use the underlying card and also depend on the device and domain;
- Stripe charges the connected account the applicable fee for the card or digital wallet actually used; it varies with account and transaction terms;
- other payment methods are offered only when Stripe permits them for the transaction and connected account; the methods shown to the viewer at checkout determine availability;
- for other available payment methods, Stripe may charge a method-specific fee under its current pricing;
- currency conversion, disputes, refunds, chargebacks, network fees or other exceptions may incur additional costs under current Stripe and payment-method terms;
- actual fees may differ because of personal Stripe pricing, country of establishment, card type, card country, currency, promotion or a pricing change. The amount recorded by Stripe and the relevant payment partner on the connected account is authoritative and is charged directly to that account; these fees are not a DonoLink fee;
- an individually agreed DonoLink percentage may be higher or lower. The donor pays the chosen amount unless they voluntarily cover only the DonoLink platform fee shown before payment. Stripe fees remain with the creator's account and the net amount is not guaranteed;
- Stripe determines availability, reserves, set-off and payout schedule and may request further information or restrict payments or payouts;
- DonoLink may change its rate for future donations under article 16 but does not retrospectively alter a completed payment. Amounts are calculated in euro and whole cents; legally due tax may be processed in addition.
Partner program. A creator can activate and deactivate their own referral link in the dashboard. When a new creator signs up through that link, the referrer receives, for 3 months from that sign-up, the percentage shown in the dashboard (standard 25%) of the platform fee DonoLink actually receives on Stripe donations to that creator. The referred creator does not pay a higher fee as a result. Refunds, chargebacks or other reversals cancel the commission proportionally; a negative balance is offset against later commission. Self-referrals, fake accounts, spam or misleading promotion lead to forfeiture of outstanding commission and exclusion. DonoLink pays out outstanding commission by bank transfer or Stripe; the referrer is responsible for any tax on the commission. DonoLink may change or end the program or the percentage for new commissions; commission already earned remains. The referrer sees the username and sign-up date of a referred creator and their own commission, but never that creator's donors, messages or balance; if that creator has their leaderboard turned off, the referrer only sees them anonymously and without a per-creator amount. DonoLink automatically checks every referral for self-referrals, including with Stripe verification data (bank account, person or company), email, browser and network. Commission only becomes payable after a successful check and lapses if the check finds that the referrer and the referred creator are the same person.
7. Refunds, chargebacks and negative balances
Donations are generally non-refundable because the donor deliberately selects the creator and payment and generally purchases no consideration. This does not limit mandatory rights or the right to dispute an unauthorised payment. A request is submitted through support@donolink.nl and states date, amount, creator, payment method and reason. DonoLink may forward the request and necessary data to the creator, Stripe, bank or payment method.
The creator is primarily responsible for assessing and funding a refund relating to their donation and must provide evidence promptly. Stripe, a bank or payment method may also issue a refund, chargeback, reserve, set-off or correction without creator or DonoLink consent. A reversal does not automatically determine the parties' legal rights.
To the extent permitted by law, refunded or disputed amounts, Stripe fees, dispute fees, reasonable investigation and collection costs and a negative creator account are for the creator. Stripe may set off or collect under its terms. The DonoLink fee is not refunded automatically, but DonoLink takes mandatory law and an error directly attributable to DonoLink into account.
8. Prohibited use and rules
You must not use DonoLink for or facilitate:
- criminal, fraudulent, deceptive, sanctions-evasive or money laundering activity, terrorist financing or unauthorised fundraising;
- stolen payment methods, self-donations for cash-out, artificial transactions, chargeback abuse, fee avoidance or manipulation of rankings, statistics, referrals or security;
- pornography or sexually explicit content, sexual exploitation, child sexual abuse material, human trafficking, doxing, credible threats, calls for violence or terrorist content;
- hateful discrimination, harassment, stalking, scams, impersonation or publication of personal data without a valid basis;
- infringement of copyright, trade mark, image, privacy or other third-party rights;
- malware, phishing, scraping beyond normal indexing, unauthorised access, bypassing limits or disrupting DonoLink, Stripe or other users.
When a concern arises, we consider factors including severity, context, reliability of evidence, repetition, intent, risk to users or payments and possible remediation. For urgency, fraud, security, illegal content, an order or provider requirement, we may act immediately; otherwise, where reasonable, we first provide a warning and remediation period.
Consequences may include: not displaying or removing content; temporarily restricting, blocking or terminating features, login, page or account; stopping initiation of new payments at DonoLink; disabling imports, integrations or overlays; preserving evidence; supporting a refund or investigation; and notifying Stripe, banks, platforms or competent authorities. DonoLink may ask Stripe to restrict payments or payouts but cannot unilaterally control funds, reserves or payouts managed by Stripe or a bank. Available funds remain subject to refunds, chargebacks, set-off, reserves, law and provider rules.
We aim for a proportionate measure and, to the extent legally and factually permitted, state its main reason, scope and duration. You may submit a reasoned appeal within 30 days via support@donolink.nl with relevant context or evidence. Where practicable, another authorised staff member reviews the appeal. We may restrict information where disclosure would harm fraud prevention, security, others' rights, an investigation or a legal duty.
9. Reporting illegal content
Report suspected illegal content via support@donolink.nl with: the legal or factual reason; exact URL or other location; your name and email, except where law permits anonymity; and a statement that the notice is accurate and complete to the best of your knowledge. In immediate danger, also call 112 or contact the competent authority. DonoLink acknowledges an actionable electronic notice and handles it promptly, diligently, objectively and without arbitrariness.
Misuse of the notice or appeal process, such as repeatedly submitting manifestly unfounded notices or complaints, may be temporarily restricted after warning. We consider number, proportion, severity, consequences and apparent intent. Good-faith reports are not penalised merely because they ultimately prove unfounded.
10. Content and intellectual property
DonoLink and its software, design, name and documentation remain protected. Except for normal use of the service, you receive no ownership or right to copy, sell, reverse engineer or exploit code, branding or design to the extent such restriction is lawful.
You retain rights in your content and warrant that you have all necessary rights and permissions. For the duration of the service, you grant DonoLink a worldwide, non-exclusive, royalty-free licence, transferable to necessary service providers and sublicensable, to host, secure, technically adapt, reproduce and display that content to operate, protect and promote your public DonoLink page. Content you place on a public page, alert or overlay is not treated as confidential; do not place secrets or data there that must not be public. You may end the licence for future use by deleting content or the account, subject to backups, evidence, already shared publications and legal retention duties.
11. Third-party services and integrations
Stripe, Twitch, YouTube/Google, Kick, TikTok, Streamlabs, OBS, banks and other services are also subject to their own terms, availability and decisions. DonoLink is not a party to your agreement with such a third party and does not guarantee any API, account, reach, payment method, verification or payout.
You connect only an account you are authorised to use and may disconnect it at any time. A third-party outage or policy change may restrict or end a feature. DonoLink may immediately disable an unsafe or no longer permitted integration.
12. Availability and maintenance
DonoLink provides a reasonable-efforts service and aims for secure, usable availability but does not guarantee uninterrupted, error-free, completely secure operation or fitness for a particular purpose. Maintenance, security incidents, internet or power outages, force majeure, cyberattacks, provider or API outages, strikes, natural disasters and legal measures may interrupt the service. DonoLink is not liable for a failure caused by circumstances outside its reasonable control. We try to remedy a defect attributable to us within an appropriate period.
We may change or discontinue features for security, law, provider requirements or product development. For a materially adverse change to an ongoing creator agreement, we provide reasonable advance notice and an option to terminate where possible, unless immediate action is necessary.
13. Liability
To the extent permitted by law, DonoLink is liable only for evidenced direct loss that is the foreseeable and immediate result of a breach attributable to DonoLink, after DonoLink has received written notice allowing a reasonable remedy period and has failed to remedy in time; no remedy period is required where performance is permanently impossible. The affected party must reasonably mitigate loss and submit a substantiated claim as soon as possible. For creators acting in business, a claim expires if not notified in writing within twelve months after discovery and total liability per event is limited to the greater of DonoLink fees paid by that creator in the preceding six months or €250; related events count as one.
For creators acting in business, DonoLink is not liable for indirect or consequential loss, missed donations, revenue or profit, loss of goodwill, data or opportunity, reputational damage, business interruption or replacement-service costs. DonoLink is also not liable for creator or donor content, tax or legal consequences of their activities, a refusal, reserve, refund, chargeback, block, outage or delay by Stripe, a bank, payment method or streaming platform, or unauthorised account use not attributable to DonoLink. These exclusions do not apply to intent or deliberate recklessness by DonoLink itself, death or personal injury caused by DonoLink, breach of a mandatory legal duty, or where exclusion is prohibited by law. Nothing limits mandatory consumer rights.
14. Loss, recovery and cooperation
A creator reimburses reasonable, evidenced loss and costs directly arising because that creator breaches these terms or third-party rights, to the extent the creator is legally responsible. This is not an unlimited indemnity and does not cover loss caused by DonoLink or which DonoLink should have mitigated.
DonoLink notifies a relevant claim promptly, gives the creator a reasonable opportunity to provide information and does not unnecessarily settle at the creator's expense. Amounts due may, where legally and technically permitted, be set off or collected through Stripe; extrajudicial collection costs follow applicable law.
15. Termination and consequences
The creator agreement runs indefinitely, without subscription fees or a minimum term, and may be terminated immediately through the dashboard or support@donolink.nl. To the extent a creator acting as a consumer has a mandatory statutory right of withdrawal, they may exercise it within the statutory period in the same way; DonoLink treats such an unambiguous request as withdrawal and charges nothing merely for the existence of the account. Pending payments, refunds, chargebacks, claims, legal records and Stripe obligations continue to be handled. Deletion from DonoLink does not require Stripe or other third parties to delete data or their account.
DonoLink may terminate or suspend under article 8. Provisions that by their nature continue, including fees, refunds, evidence, liability, intellectual property, disputes and legal retention, survive termination.
16. Changes to terms and rates
We may amend these terms or future rates due to law, security, provider rules, costs, functionality or operations. For creators, we announce a material change at least 15 days in advance by email or durable notice, or longer where adaptation reasonably requires more time. The creator may terminate without charge before the effective date. A shorter period applies only where law, security, fraud or a provider duty requires immediate action. A donor is bound by the version presented before that specific payment; later changes are not retrospective.
17. Law, complaints and courts
This agreement is governed by Dutch law, including the Dutch Civil Code. Processing of personal data is governed in particular by the General Data Protection Regulation (GDPR) and hosting and the handling of illegal content, where applicable, by the Digital Services Act. These references do not expand DonoLink's statutory role. A consumer always retains mandatory protection under the law of their habitual residence. The parties first try to resolve a complaint within 30 days via support@donolink.nl.
Disputes are submitted to the court having jurisdiction under applicable law. A consumer is not required to litigate exclusively in Eindhoven or the Netherlands where mandatory jurisdiction rules designate another court.
Failure to exercise a right immediately is not a waiver. Electronic records, logs and provider records may serve as evidence without limiting any statutory right to provide counter-evidence.
